Terms of Service

These terms govern your use of Take the Crown at takethecrown.app (the "Service"). The Service is operated by Dario Sarango, a natural person residing in Ecuador ("we", "us"). Contact: hola@takethecrown.app.
By using the Service you agree to these terms. If you do not agree, do not use it.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live if higher, to make a purchase. You must be at least 16 years old to create an account.
2. What the Service is
Take the Crown is a game with a single crown. Whoever holds it is featured on the homepage with their name, avatar, a short message and a link, until someone else takes it. Your reigns, statistics, ranks and achievements are recorded on your public profile.
3. What you buy
When you pay to take the crown, you buy a featured placement that starts immediately and lasts until another player takes the crown or the season ends, plus a permanent record of that reign on your profile.
- There is no minimum or guaranteed duration. Another player can take the crown at any moment, including seconds after you.
- The crown, ranks, achievements, seasonal items and any other in-game element have no monetary value, cannot be exchanged for money or transferred, and do not give you ownership of anything.
- There are no prizes, cash rewards or payouts of any kind, and no outcome depends on chance. The price is shown before you pay.
- You cannot buy the crown while you hold it.
4. Prices and payment
The price is in US dollars and follows the rules published on the Rules page: it rises with every takeover and decreases over time, never below a minimum. When you start a purchase, the price is reserved for you for a few minutes.
Payments are processed by Dodo, which acts as the merchant of record and seller of the transaction. Its terms also apply to your payment. We never receive or store your card details. Taxes may be added according to your location.
5. Delivery and refunds
The placement is digital content delivered immediately when your payment is confirmed. By completing the purchase, you request immediate delivery and acknowledge that you lose any right of withdrawal once the crown is delivered, to the extent permitted by the law that applies to you.
All purchases are final once delivered, except for refunds that Dodo grants under its own buyer terms. Purchases are refunded automatically only when the crown cannot be delivered, for example if your reservation expired and another player took the crown before your payment was confirmed, or if the season ended in the meantime.
Content hidden for breaking these terms, as described in section 7, does not give a right to a refund, because the placement itself is still delivered.
If a delivered purchase is refunded or charged back, its reign stays in the public history marked as refunded: its message and link are hidden, it no longer counts toward leaderboards, ranks or statistics, and the achievements earned through it are removed. If you open a chargeback, we also suspend your account.
6. Accounts and names
You can buy without an account using your email. An account created later with the same email takes over those purchases. If an email already belongs to a profile, you must verify it before buying with it.
Your public name must follow the published rules and cannot impersonate another person, brand or the Service. You can change it once every 30 days. Previous names stay reserved for you. We may change or release names that break these terms.
You are responsible for keeping access to your email and sign-in methods secure.
7. Your content
Your name, avatar, message, links and profile information ("your content") are public.
You keep ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce and adapt it as needed to operate and promote the Service, including on share images, for as long as it remains in the Service and its public history.
You must not post content that:
- is illegal, hateful, harassing, threatening, sexual or violent;
- impersonates someone or misleads about its origin;
- promotes scams, malware, phishing, gambling or illegal products;
- links to chat invitations, link shorteners or content that hides its destination;
- infringes the rights of others, including intellectual property and privacy;
- tries to manipulate our moderation systems.
All content is reviewed by automated systems and may be reviewed by us. Content can be held for review before it appears, hidden or removed at any time, without notice and without a refund. Links you post are marked as sponsored for search engines.
8. Fair play
You must not use bots, automate purchases or reservations, interfere with the Service, exploit errors, use stolen payment methods or other people's emails, or circumvent limits and moderation. We may suspend or ban accounts and block purchases that break these terms.
9. Changes to the game
We may adjust game rules, such as prices, increases, decay, reservation time, ranks, achievements and seasons, at any time. Changes apply to future takeovers and do not affect purchases already delivered.
10. Intellectual property
The Service, its software, design, artwork, pixel art, avatars, names and logos belong to us or our licensors. You may share links and share images generated by the Service. Any other use requires our written permission.
11. Availability and disclaimer
The Service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free or available at any particular time, or that your placement will produce any traffic, sales or result.
12. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages, loss of profits, data or reputation. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits rights that the consumer protection law applicable to you does not allow to be limited.
13. Termination
You can stop using the Service and delete your account at any time from your profile settings. We may suspend or terminate your access if you break these terms. Your past reigns remain in the public history without your personal details.
14. Governing law
These terms are governed by the laws of Ecuador. Disputes will be submitted to the competent courts of Cuenca, Ecuador, Ecuador, without prejudice to any mandatory consumer protection rights in your country of residence.
15. Changes to these terms
We may update these terms. We will publish the new version with its effective date and, for significant changes, notify you by email or on the Service. Continuing to use the Service after that date means you accept the new version.
